These Terms and Conditions govern the access to and use of the website and services provided by Circle Human Consulting, as well as the relationship with companies or professionals ("the User," "the Company," "the Candidate"). By accessing or using our services or the website, the User acknowledges and accepts these Terms. If the User does not accept the Terms, they must refrain from using our services. 1. Acceptance of the Terms
The use of the website's features or any service provided by Circle Human Consulting implies full acceptance of these Terms, as well as the Privacy Policy, which forms an integral part of them.
We reserve the right to modify or update the Terms or the Privacy Policy at any time. Updated versions will be published on the website with the date of the last revision indicated. Continued use after the publication of changes constitutes tacit acceptance by the User.
2. Services Provided to Companies
If a Company contracts HR consulting, executive search, employer branding, talent management, outplacement, or other services, specific conditions defined in the contractual agreement between the parties will apply.
Such specific conditions will be made available in writing or upon request to Circle Human Consulting via contacto@circle-consulting.pt.
3. Services for Professionals / Candidates
Registering as a Candidate, submitting a CV, or providing data for recruitment purposes constitutes express consent to be contacted by Circle Human Consulting consultants regarding opportunities that match their profile.
The Candidate may, at any time, request the removal of their personal data from Circle Human Consulting's database or the closure of their account by contacting contacto@circle-consulting.pt.
Submitting a CV or other personal data does not guarantee a job offer or interview, as such decisions are at the sole discretion of employers or clients using our services.
4. Use of the Website / Platform
The Circle Human Consulting website is intended to provide institutional information, present services, facilitate contact with our team, and allow the submission of applications. All content is provided "as is," without express guarantees regarding accuracy, timeliness, or completeness, and technical errors or interruptions may occur.
The following are strictly prohibited:
a) Using the website for commercial or promotional purposes without prior written authorization.
b) Sharing illegal, discriminatory, offensive content or content that infringes third-party rights.
c) Promoting activities contrary to applicable law.
d) Obstructing or disrupting the use of the platform by other users or compromising system security.
e) Reproducing or distributing content protected by copyright or intellectual property rights without express authorization.
Failure to comply with these obligations may result in suspension or cancellation of the User's access or account, without prejudice to applicable legal liability.
5. Registration
Some features require prior registration. The User undertakes to provide true, accurate, and updated information and to maintain it throughout their relationship with Circle Human Consulting. In case of suspected unauthorized access or security breach, it is the User's responsibility to immediately inform Circle Human Consulting at contacto@circle-consulting.pt.
Circle Human Consulting reserves the right to suspend or terminate accounts in case of violation of these Terms.
6. Cancellation and Deletion of Personal Data
The User has the right to request the cancellation of their account and the deletion of their personal data from Circle Human Consulting's database by contacting contacto@circle-consulting.pt. We will confirm receipt of the request and proceed with the necessary measures within a reasonable timeframe, except where there is a legal obligation to retain data for a specific period.
7. Data Protection and Applicable Regulation
The processing of personal data will be carried out in accordance with Regulation (EU) 2016/679 — the General Data Protection Regulation (GDPR), as well as applicable Portuguese law, namely Law No. 58/2019 of August 8.
The User has the legally granted rights, including the right to access, rectify, erase, restrict processing, data portability, object, and withdraw consent. In the event of data transfers outside the European Economic Area, legal safeguards will be implemented to ensure equivalent protection. In case of a personal data breach, Circle will notify the competent authority (Comissão Nacional de Proteção de Dados – CNPD) and inform the affected User, in accordance with applicable legal requirements.
8. Liability
Circle Human Consulting strives to provide its services under conditions of availability, security, and functionality. However, it cannot guarantee that the website and services will always be available or free from failures or interruptions. Circle Human Consulting shall not be liable for indirect damages, loss of profits, or consequential damages that are not legally enforceable. In the event of liability, Circle Human Consulting's responsibility shall be limited to foreseeable direct damages, unless otherwise provided by law.
9. Intellectual Property
All website content (texts, trademarks, logos, images, graphics, layout, etc.) is the property of Circle Human Consulting or entities that have granted express authorization. Reproduction, adaptation, distribution, or use of such content without prior written authorization is strictly prohibited.
10. Governing Law and Jurisdiction
These Terms are governed by applicable Portuguese law, including the Civil Code, the Labour Code, and data protection legislation.
